When visiting our website in order to enroll in one of our programs, make a purchase, register to use certain services, enter a contest, respond to a survey, or update your information, you may be asked to provide certain personally identifiable information about yourself ("Personal Information"), such as your name, email address, physical address, telephone number, date of birth, or mother's maiden name. For enrollment and purchases, we require a name, physical address, telephone number, credit or debit card or related checking account number, card expiration date and CVV or similar code. You may review and revise any Personal Information we have about you by sending a request to privacy@fimac.us or calling 949-359-6100.

As you use our website, we may collect certain information, such as the Internet Protocol (IP) address of your device (as described in Section 8 below) and the web pages you visited, without you providing the information.  We may also use cookies (as described in Section 7 below). We may also request non-personally identifiable information (“Demographic Information”), such as annual income or buying preferences. Providing Demographic Information is optional. This information is maintained anonymously, so we have information about everyone as a group who visits our website or answered the questions, rather than information about a single individual’s responses.

3.Information Usage

We use Personal Information to perform business functions, such as serving our members and other customers, developing new products and services, fulfilling orders, preventing and detecting fraud and contacting you when necessary, such as when a delivery may be delayed or when an ordered product is out of stock. We may also use this information to notify you about new products or services and special promotions offered by FIMAC or any of its affiliates.

We may use information that we collect from you to (i) improve and enhance your experience on the FIMAC website, and (ii) tailor your experience at our website, such as by showing you content and sending you notices concerning merchandise and services that may interest you. In the event of a sale of all or substantially all of our business or another similar transaction (such as a sale of a division or business unit), we may transfer or disclose your Personal Information to a purchaser or prospective purchaser, who may collect, use and disclose such information for the purposes of evaluating and/or effecting a proposed transaction or operating and managing the affairs of the acquired business, or for other purposes identified in this privacy policy.

5.Opting Out of Sharing of Personal Information; Choice With Respect to Receiving Marketing Emails

Any information that you enter on an enrollment or other form on our website may be collected and retained by FIMAC, even if you decide not to enroll, may be used by FIMAC to send you future promotional information, and will be subject to the terms and conditions of this Privacy Policy.

We value your privacy. If at any time you do not want us to share your Personal Information with unaffiliated third parties (other than those disclosures otherwise required or permitted by law) or if you would prefer not to receive marketing emails from FIMAC in the future, please let us know by sending an email to marketingoptout@fimac.us with the words “Opt Out” in the subject line. Please allow up to 10 days for your email address to be removed.

6.Your California Privacy Rights

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship, (1) a list of the categories of personal information, such as name, address, email address, and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties' direct marketing purposes, and (2) the names and addresses of all such third parties. We will respond to such written requests within 30 days following receipt at the email or mailing address stated above. If we receive your request at a different email or mailing address, we will respond within a reasonable period of time, but not to exceed 150 days from the date received. Please note that we are only required to respond to each customer once per calendar year.

7.Cookies

"Cookies" are pieces of information that may be placed on your computer by a website for the purpose of facilitating and enhancing your communication and interaction with that website. Almost all websites use cookies for these purposes.

Our systems do not respond to “do not track” signals.  Further, other parties may collect certain personally identifiable information about your online activities over time and across different websites when you use the FIMAC website or services.

8.Internet Protocol (IP) Address

We may use your IP address to help diagnose problems with our server and to administer our website. Your IP address may also be used to help identify you.  In addition, your IP address may be linked to your personally identifiable information while you are in the process of making a purchase, and be retained by us with other information we collect and retain about you in connection with your FIMAC products.

9.Clickstream

As you use the Internet, a trail of electronic information is left at each website you visit. This information, which is sometimes referred to as "clickstream data," can be collected and stored by a website's server. Clickstream data can tell us the type of computer and browsing software you use, the address of the website from which you linked to the FIMAC website, and in some instances, your email address. We may use clickstream data to determine anonymously how much time visitors spend on each page of our website, how visitors navigate throughout the website, and how we may tailor our web pages to better meet the needs of visitors. FIMAC is headquartered in the United States. Please be aware that information you provide to us or that we obtain as a result of your use of the website or our products may be collected in your country and subsequently transferred to, maintained and processed in the United States or another country by us or our service providers for the purposes mentioned above in accordance with applicable law.  The privacy laws of these countries may not always offer the same level of protection as in your country. By using our website, you consent to the collection, international transfer, storage and processing of your information.

12.Links to Other Websites

Our websites may contain links to other websites. Other websites may also reference or link to our websites. FIMAC is not responsible for the privacy practices or the content of such other websites.

 

13.Maintaining the Security of Your Information

We have implemented security procedures which use reasonable measures to ensure the security, confidentiality, and integrity of Personal Information in our possession and guard against unauthorized access or use. We also identify data that is to be protected, provide a reasonable level of protection for that data and grant access to protected data only to those individuals who need to use it in performing their job-related duties. However, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and FIMAC and your Personal Information will be free from unauthorized access by third parties, such as hackers. Employees who violate our security procedures will be subject to disciplinary action, which may include termination. FIMAC utilizes standard SSL encryption on pages where secure information is transmitted over the Internet. We also use DigiCert as our Certificate of Authority.

14.Treatment of Information of Former Members and Customers

We will continue to follow our Privacy Policy for your Personal Information even when you are no longer a member or other customer of our business.

15.Your Acceptance of This Privacy Policy

By using our website, you signify your assent to this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use our website. This Privacy Policy supersedes all privacy policies and other similar standards previously issued by us specifically for FIMAC. This Privacy Policy is subject to updates and other changes at any time.
